Introduction to the Terms of Use Agreement

This agreement applies to all types of transactions between the consumer and the store. This agreement becomes effective and binding immediately upon your acceptance and upon starting the registration process in the store in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article 1 – Introduction and Definitions

The above introduction is an integral part of this agreement. Below are the definitions of the main terms used in this agreement:

1. Store: This term includes all forms of the store on the internet, whether it is an electronic application, a website, or a physical commercial shop.
2. Consumer: A person who engages in e-commerce in order to obtain products or services provided by the store through its electronic platform.
3. Agreement: Refers to the terms and conditions of this agreement that govern and regulate the relationship between the parties of this agreement.

Article 2 – Consumer Legal Eligibility

1. The consumer acknowledges that they have the legal capacity recognized under Sharia and applicable regulations to deal with the store, or that they are at least eighteen (18) years old.
2. The consumer agrees that if they violate this article, they will bear the consequences of such violation before third parties.

Article 3 – Nature of Commitment

1. The store’s obligation toward consumers is to provide the service or product.
2. The store may provide additional services such as after-sales services or other related services depending on the nature and type of the requested service or product.

Article 4 – Rules of Use

1. The consumer agrees to use the store’s electronic platform in accordance with public morals and the applicable laws and regulations of the Kingdom of Saudi Arabia.
2. When purchasing a service or product from the store, the consumer agrees not to use it in any way that violates public morals or the applicable laws and regulations of the Kingdom of Saudi Arabia.

Article 5 – Accounts and Registration Obligations

Upon applying for membership in this store as a user, you are required to disclose certain information and choose a username and a confidential password to access the store’s services. By doing so, you agree to the following:

1. You are responsible for maintaining the confidentiality of your account information and password and must immediately notify the store of any unauthorized use of your account information or any breach of your confidential information.
2. The store will not, under any circumstances, be liable for any direct or indirect loss, whether moral or material, resulting from the disclosure of the consumer’s username or password.
3. You agree to use your account personally and are fully responsible for it. If someone else uses it, it will be considered that you have authorized them to use the store on your behalf.
4. You agree to use the store seriously and honestly.
5. You must provide true, accurate, current, complete, and lawful information about yourself as required during registration and update your information whenever necessary.
6. Our store commits to handling your personal information and contact details with complete confidentiality.
7. If the store determines that you have provided false, inaccurate, outdated, incomplete, unlawful information, or information that violates this agreement, the store has the right to suspend, freeze, or cancel your membership or account without prejudice to the store’s other rights to recover its rights and protect other consumers.
8. Failure to comply with any of the above gives the store management the right to suspend or cancel your membership or prevent you from accessing the store’s services again.

Article 6 – Electronic Communications and Official Contact Methods

1. The parties to this agreement agree that communication will be conducted via the email registered on the platform.
2. The consumer agrees that all agreements, notices, statements, and other communications provided electronically shall take the place of their written counterparts and constitute valid legal proof.
3. The consumer agrees that the store management may contact them or notify them regarding matters related to this agreement by sending general messages to all consumers or to specific users of the store.

Article 7 – Amendments to the Terms of Use and Fees

1. If any clause or provision in this agreement is canceled or becomes invalid, this will not affect the validity of the remaining provisions, which will remain in force until further notice from the store management.
2. This agreement—amended from time to time as necessary—constitutes the mechanism for operation, understanding, and agreement between the consumer and the store.
3. The store may impose fees on some consumers depending on the offers, products, or services requested or due to fees or taxes imposed by the government related to the nature of the product or service.
4. The store reserves the right to add, increase, decrease, or deduct any fees or expenses under the provisions of this agreement for any consumer regardless of the reason for registration.

Article 8 – Payment Services

1. The store provides payment and billing services through its partners, allowing payments to be made entirely online through the available payment options or through any payment methods provided by the store from time to time.
2. The store is committed to determining the price of the service or product offered according to the prevailing market value.
3. The store commits to issuing invoices, receipts, and payment documents for all amounts and profits generated in the store and to providing the consumer with an invoice for any purchased service or product.
4. The store commits to applying standard accounting practices in its online store in accordance with the provisions of this agreement.

Article 9 – Intellectual Property

1. All intellectual property rights related to the store are fully owned by the store, whether they existed before or after the establishment of this electronic platform.
2. The consumer agrees to respect the store’s intellectual property rights, including the store’s name, words, logos, and other symbols displayed on the platform, which are considered fully owned intellectual property of the store.

Article 10 – Store Responsibility

1. The store commits to conducting its business through this electronic platform in compliance with the applicable laws and regulations of the Kingdom of Saudi Arabia and the provisions of this agreement.
2. The store is not responsible for any claims resulting from errors or negligence, whether direct, indirect, incidental, or caused by the consumer or by third parties such as shipping companies.
3. The store and its employees, owners, and representatives commit that the product or service provided is legitimate, lawful, and permitted under the laws and regulations of the Kingdom of Saudi Arabia and is used for lawful purposes.

Article 11 – Restricting Access or Membership

The store may suspend or cancel a consumer’s membership or restrict their access to the platform’s services at any time without prior notice and for any reason.

Article 12 – Applicable Law

This Terms of Use agreement is governed by and interpreted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is fully subject to the applicable authorities within the Kingdom.

Article 13 – General Provisions

If any clause or provision in this agreement becomes invalid, it will not affect the validity of the remaining provisions, which shall remain in effect until further notice from the store management.

This agreement—subject to amendments when necessary—constitutes the mechanism of work, understanding, agreement, and contracting between the store and the consumer. Both parties acknowledge the following:

1. The Arabic language shall be the official language used in interpreting this agreement or translating it into any other language.
2. All prices displayed for the store’s services or products may change from time to time.
3. Promotional or marketing offers provided by the store are temporary, and the store reserves the right to modify or stop them at any time.
4. Both parties agree to conduct their dealings in a manner consistent with Sharia principles and the applicable laws and regulations governing the relationship between the store and the consumer.
5. This agreement may only be canceled by a decision issued by the store management.
